Justice Vasheist Kokaram will deliver the ruling in the judicial review claim brought by the Law Association of Trinidad and Tobago LATT on Feb 19th 2020. The review stems from the decision of Prime Minister Dr Keith Rowley not to invoke impeachment proceedings against Chief Justice Ivor Archie.

LATT stated in its arguments that Dr Rowley refused to carry out his constitutional functions in the public interest by recommending to Her Excellency The President that impeachment proceeding be initiated against the Chief Justice under Section 137 of the Constitution. The LATT is seeking to have the Courts declare Dr. Rowley’s decision as illegal, irrational, unreasonable and in bad faith. It’s also seeking a Court order to quashing Dr Rowley’s initial decision and yet another compelling him to reconsider it.
Based on advise from QC Howard Stevens the Prime Minister refused to make the recommendations to the President.
