UNC activist Devant Maharaj has been granted permission to challenge the Minister of National Security, Stuart Young, on his border exemption policy.
Maharaj said there are hundreds of requests from citizens stranded outside TT and yet people do not know the criteria used to determine whether they can get an exemption or not.
High Court judge Justice Ronnie Boodoosingh granted permission to Maharaj on Monday, to file a claim for judicial review against Young, after the minister failed to provide the requested information in response to a Freedom of Information request that was issued in June.
Maharaj is seeking a declaration that the ministry’s decision to not disclose the information within 30 days of the request is illegal and contrary to section 15 of the Freedom of Information Act.
He also wants the court to declare that he is entitled to the information and he wants copies of all applications that were approved since the borders were closed in March.
The matter will be heard next Wednesday.
